Mr. Chan and RSM Hong Kong (former employer of Mr. Chan) were the subjects and respondents if a past investigation conducted by Financial Reporting Council ("FRC") in respect of an audit of a Hong Kong listed company, and its subsidiaries, for the year ended 31 December 2016. Chan was the engagement partner of the audit. The Hong Kong Institute of Certified Public Accountants ("HKICPA") received a referral from the FRC about audit irregularities. FRC's investigation revealed that, among others, the respondents failed to design and perform appropriate audit procedures to obtain sufficient appropriate audit evidence pertaining to the receivable, the impairment loss on the receivable, and the exchange reserve. In lieu of further proceedings, the respondents acknowledged the facts of the case and their non-compliance with professional standards; be reprimanded; and each paid administrative penalties to HKICPA, and jointly paid costs to HKICPA and FRC, and the matter was concluded in 2022.
